This document is updated often, so please check back often for revisions. Reports of activity in violation of this policy may be sent via e-mail to abuse (at) jagfly.com. If you are unsure of whether an activity you wish to partake in violates our AUP (acceptable use policy), please email support at support@jafly.com before hand for counsel. It's best to be safe than sorry.

Commercial Advertising - Email
Jagfly Hosting holds a zero-tolerance policy to spam. Spamming, or the sending of unsolicited email, from our server or using an email address or domain that is maintained on our machine as reference is stictly prohibited. Any user caught violating our spam policy will have their account immediately suspended without notice. No refund is given in this circumstance. Furthermore, A $10 penalty will be assessed for each unsolicited email sent from our servers.

You may not alter the headers of email messages to disguise their identity or to prevent users from responding to the messages. Jagfly Hosting may disclose the usernames of accounts responsible for forged email messages to system administrators, or law enforcement offices requesting the information.

Web Site Content Policy

All services provided by Jagfly Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Jagfly Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography and sex-related links or merchandising is prohibited on all Jagfly Hosting servers. This includes sites that may infer sexual content, or links to adult content elsewhere. Jagfly Hosting will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:
• Pirated software
• Hacker programs or archives
• Warez sites
• Copyrighted material such as MP3, e-books, movies, etc.

Additionally, the use and/or publishing of content for which you are not legally entitled to use, including HTML web design, site graphics, photographs, site content, programming, software, and other components associated with a web site or digital media, is strictly prohibited from the servers at Jagfly Hosting. Jagfly Hosting is obliged to honor an attorney drafted cease and desist order providing it sufficiently documents the copyright violations, and Jagfly Hosting will remove the infringing content if directed to do so. Jagfly Hosting will not mediate or arbitrate the situation, as the situation must be resolved by mutual understanding between the copyright holder and the infringing party.

Account Ownership

Jagfly Hosting is only responsible to the present owner of the Web hosting space. We verify ownership by credit card number (if paid for by credit card), name, address, email address, username, & password. If you give this information to any other party or give access to your email address on your account to another party, you risk having your Web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information to another party who causes damage to your account and/or Web site.

System Security

You are prohibited from utilizing the services to compromise the security of system resources or accounts on servers at Jagfly Hosting or at any other site. Use or distribution of tools designed for compromising security or containing viruses or trojans are prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

In using shell access (SSH) or FTP you should only view and manipulate your own files within your own home directory. We log and monitor all server activity (ssh, ftp, http, e-mail) and if catch a user visiting areas of the server that are not in their home directory, or viewing files which are not owned by the user, we will immediately suspend yout account.

If you are involved in violations of system security, Jagfly Hosting reserves the right to release all usernames of users involved in such violations to system administrators at other sites in order to assist them in resolving security incidents. Jagfly Hosting will also fully cooperate with law enforcement authorities in investigating suspected lawbreakers.

System Resources

System abuse includes any use of Jagfly Hosting resources that disrupts the normal use of its servers or services for others. Examples of system abuse include running excessive numbers of processes or consuming excessive amounts of CPU time, memory or disk space. Persistant or concurrent FTP or SSH connection also add undue burden on the servers and may result in termination.

Any usage of 10% or more of Jagfly Hosting's server system resources is an undue burden on Jagfly Hosting's system and is unacceptable. If your usage ever exceeds 10% of system resources, your account may be terminated immediately and without prior notice. Jagfly Hosting can set an additional domain name to be pointed to your site's IP address for a one-time $10 setup fee. Usage of scripts or other utilities to direct pointed domain names to subdirectories is not permitted and is grounds for termination.

Further, running programs in the background on a Jagfly Hosting server without Jagfly Hosting's prior written authorization, or running chat rooms, web cam streams and transmission, streaming video, Internet Relay Chat, IRC bots, mailing lists that send more then 2,500 emails a day and the like are not acceptable uses of Jagfly Hosting's servers and are grounds for account suspension and termination without notice.

You are allowed to run your own CGI and PHP scripts on the server. However, we reserve the right to disable any CGI script that effect normal server operation or service to other Jagfly Hosting customers. For the protection of all our customers, we also reserve the right to discontinue service to those customers who continue to run scripts that effect normal server operation. No chat rooms or similar scripts allowed.

Cancellation Policy
You may cancel at anytime. To cancel your account, please submit a support request. As a policy, we do not offer credits or refunds for hosting time already expended. We do give refunds after charging you for months already used calculated on the monthly hosting price for your plan, should you want to cancel prepaid service. Setup fees and domain registration fees are non-refundable.

Backups

Full backups are made weekly, and backups of new/changed data made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and any information on their account including but not limited to clients website, email, databases, mailing lists, and archives. If loss of data occurs due to an error of Jagfly Hosting, we will attempt to recover the data at no charge to the client. Again, no guarantee is made regarding the integrity or completeness of our backup archives.

Support Policy

At the current time, we only offer technical support via our trouble ticket system located in the Support area. Should you have an question, we first advise you to check out the support area and frequently asked questions to see if you question can be answered by reading our documention. If you cannot find an answer in the support area please submit your support request via our trouble ticket system and one of our technical administrators will respond as soon as possible.

Sub Hosting Policy

You may only host one web site on per account at Jagfly Hosting. Usage of scripts or other utilities to direct pointed domain names to subdirectories is not permitted and is grounds for termination.

Traffic Policy

Each account comes with a specific monthly bandwidth limit. If your account reaches it's limit, your web site may be temporily suspended until either a new billing cycle occurs (resetting your monthly bandwidth limit) or you contact support to make arrangements to purchase additional bandwidth. Jagfly Hosting customers are discouraged from storing any files that cause excessive traffic on Jagfly Hosting servers.

Payment Policies and Fees:
Full payment is required before any hosting service is rendered, which includes renewals. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. Accounts that are past due by 30 days will be suspended. Once payment is made service will be restored. Prepayment is due each anniversary (one month, three month, six month, one year, two years) following the date the account was established. Additional features can be added at any time. Monthly feature prices are not prorated. Jagfly Hosting reserves the right to change prices or plans at any time.

Returned Check Fee

Jagfly Hosting charges a $25.00 fee for returned checks as well as charge backs. For international customers: check or money order funds must be drawn in US dollars.

Indemnification Policy
We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law. You agree to use all Jagfly Hosting services and facilities at your own risk. Jagfly Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Jagfly Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Jagfly Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Jagfly Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Jagfly Hosting against liabilities arising out of:

1. any injury to person or property caused by any products sold or otherwise distributed in connection with Jagfly Hosting’s server;
2. any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
3. copyright infringement and;
4. any defective products sold to customer from Jagfly Hosting’s server.

Jagfly Hosting shall be the sole judge of what violates this Policy.
